CASE DISMISSED LESS THAN THREE MONTHS AFTER OLG RETAINED; OLG DEFEATED SUBSEQUENT APPEAL

The Los Angeles Superior Court granted OLG’s Anti-SLAPP Motion dismissing plaintiff’s entire lawsuit alleging violation of the Los Angeles rent control law and Intentional Infliction of Emotional Distress after plaintiff’s eviction from property owned by OLG’s client. OLG was retained following a seven-year-long legal battle between the parties.

Through a prior unlawful detainer action, OLG’s client had obtained and enforced a judgment for possession against the plaintiff. Years later, the judgment for possession was overturned on appeal, and OLG’s client dismissed the unlawful detainer action. In response, the plaintiff filed a new lawsuit against OLG’s client alleging that her eviction from the property violated the rent stabilization ordinance and caused her severe emotional distress. OLG secured the dismissal of the lawsuit less than three months after being retained. OLG then defeated both the plaintiff’s motion for reconsideration of the dismissal and the plaintiff’s appeal to the Court of Appeal. The California Supreme Court denied the plaintiff’s petition for review.

Sherri Matta wrote and argued the winning Anti-SLAPP motion and opposition to the motion for reconsideration. Ms. Matta also wrote the Respondents’ Brief and successfully defended the judgment at oral argument in the Court of Appeal, Second Appellate District.
