PLAINTIFF DISMISSES FRIVILOUS LAWSUIT AGAINST CEMETERY
A plaintiff filed a lawsuit alleging fraud related to the burial arrangements for his mother, asserting that OLG’s client, a cemetery, had violated various regulations and statutes. The plaintiff claimed that the cemetery wrongfully contracted with his brother without his notice, seeking over $160,000 in compensatory damages, punitive damages, the disinterment of his mother’s remains, and a criminal referral to the district attorney.
OLG’s initial investigation uncovered public records that contradicted the plaintiff’s claims. Despite being presented with this evidence, the plaintiff continued to pursue his case. In response, OLG filed a demurrer and motion to strike the complaint. Shortly thereafter, the plaintiff voluntarily dismissed the case, less than two months after OLG’s involvement.
